Can a divorce be contested?

Since the introduction of No Fault divorce in April 2022, it is no longer possible to contest a divorce. Having said that, there are several ways in which the divorce application can be contested on legal grounds.

These specifically relate to:

  • Jurisdiction – if either of you live abroad the English and Welsh courts may not be able to handle the application.
  • Validity – if either party can prove that you were not legally married in the first place.
  • Previous divorce – if you have already legally ended the marriage in another country.

If any of these circumstances apply, we would recommend you seek legal advice and respond to the divorce application explaining why you dispute the proceedings.
