What is an injunction?

An injunction is a court order made under the Family Law Act that instructs a person that they are prohibited from committing certain actions. The most common situation in which injunctions are used is when a relationship has broken down and one of the parties is alleged to be harassing, threatening or assaulting the other.

What orders are available under the Family Law Act 1996?

There are two types of order available, often colloquially known as injunctions.

A Non-Molestation Order is a court order that instructs a person that they are prohibited from committing certain acts. The most common situation in which this is used is when a relationship has broken down and one of the parties is alleged to be harassing, threatening, or assaulting the other.

The other type of Order is an Occupation Order, and this is used to control who lives in the family home. One party can be ordered to leave if the circumstances are serious enough.
